"A responsible prosecutor would never have filed this indictment," says Krasniqi's lawyer
Jakup Krasniqi's lawyer, Venkateswari Alagendra, has launched her final statement to refute the claims of the Specialized Prosecutor's Office, based on which the charges against him have been filed.
Alagendra was clear that the SPO is relying on “speculation and unsupported allegations” in the accusations against Krasniqi.
According to the defense, the prosecution's accusation against Krasniqi for the detainees in Malisheva says a lot about the prosecutor who filed it.
“After concluding his arguments, the Prosecutor withdrew his claim that Jakup Krasniqi was present and visited the room where certain persons were detained in Malisheva. This was the only claim of the Prosecution, that Jakup Krasniqi saw with his own eyes a victim who was being held in detention. A responsible prosecutor would never have raised such an allegation.”
She further says that there is no witness who says that Krasniqi mistreated her.
"Honorable judges, I ask you that when you review the evidence presented by the Prosecution, do not forget these facts. In all the evidence, there is not a single witness who claims that Krasniqi beat, abused or tortured them. There is not a single victim out of hundreds of Prosecution witnesses who claim or accuse Krasniqi of beating them, abusing them or being present when they were mistreated. This prosecution relies mainly on speculation and unsupported allegations," she said,
Therefore, Alagendra accused Kimberly West's office of selecting documents and parts of witness testimonies according to its interests, adding that it ignored parts of the testimonies that did not suit the SPO.
“These are demonstrating how unacceptable the prosecution’s approach to the evidence was. This indictment should not have been filed at all. We submit that the prosecution should have withdrawn the indictment. The prosecution continued to stand by its unsupported position.”
