"Extraordinary elections", Kryeziu shows the three possible scenarios after the decision that the Constitutional Court is expected to make

Former judge of the Constitutional Court of Kosovo, Kadri Kryeziu, has shared his position regarding the decision that the Constitutional Court is expected to make on August 8 regarding the situation created after the failure to constitute the Kosovo Assembly.

Through a reaction on social media, Kryeziu presented three possible scenarios, emphasizing that these are only personal opinions and that the real value belongs only to the decision of the current composition of the Court.

The first scenario, which he believes is the most rational and likely, foresees the Court recognizing the President of the Republic's right to declare extraordinary elections. Kryeziu argues that the failure to constitute the Assembly is hindering the formation of the Government and the functioning of political power, which constitutes an institutional crisis that justifies this step.

The second scenario, which he calls less desirable, is where the Court decides to “reset” the 30-day deadline for the constitution of the Assembly, returning responsibility back to the current legislature. Kryeziu says such a decision could damage the seriousness of the Constitution.

The third scenario, which he describes as the worst, is where the right to nominate the Speaker of the Assembly passes from one parliamentary group to another. According to Kryeziu, this would constitute a change of the rules of the game during the process and would be legally unacceptable.

Speaking about the current composition of the Constitutional Court, Kryeziu expressed appreciation for the professionalism and intellectual courage of the judges, saying that he believes that their decision will bring the country out of legal uncertainty.

In the end, he did not spare a single criticism of the former head of the Constitutional Court, Enver Hasani, considering him responsible for the current situation and expressing regret for his former silence which, according to him, helped in the realization of "dark plans".

Kryeziu said that regardless of the decision that the Constitutional Court will make, this legislature has already lost credibility and that elections are the only way to restore the trust of citizens.
