Suspect in money counterfeiting released from custody

The Gjilan Prosecution requested from the Gjilan Court the detention of the defendant Senad Aliu from the village of Geraj in the municipality of Presheva, suspected of the criminal offense of counterfeiting money.

State Prosecutor Arben Ismajli stated during the hearing that he fully supports the submitted request, adding that there are grounds for ordering detention against the defendant, adding that if he is released, he could escape, since he is a citizen of Serbia, and influence witnesses in the case such as: Arbër Idrizi, Florent Nexhipi and Altin Dalipi.

At this stage of the proceedings, the prosecutor presented a CD to the court, where he claimed that the defendant Arbër Idrizi is seen making the payment at the "Waikiki" store in Gjilan, while Senad Aliu is next to him.

Defendant Senad Aliu and his defense attorney Shemsedin Piraj opposed the request for pre-trial detention.

The pre-trial judge, Naser Maliqi, after reviewing all the case files and hearing the parties' claims, came to the conclusion that the request of the Prosecutor's Office in Gjilan to order pre-trial detention against the defendant Senad Aliu should be rejected.

In his reasoning, Judge Naser Maliqi added that in order to order detention, there must be a reasonable suspicion that the defendant has committed the criminal offense for which he is accused. Among other things, based on evidence such as the CD obtained from the "Waikiki" shopping center in Gjilan, then the security camera recordings from this center, there is no reasonable suspicion that the defendant Senad Aliu is the perpetrator of the offense for which he is accused.

According to the decision of Judge Naser Maliqi, the Prosecution's claim that Senad Aliu was under the escort of Arbër Idrizi is only an assumption unsupported by a single piece of evidence, therefore, based on this aforementioned data, Judge Naser Maliqi assessed that the legal condition for ordering detention has not been met.

In this decision, the Detention Center of the Police Station in Gjilan is obliged to immediately release the defendant Senad Aliu today.

According to the Prosecution, Senad Aliu is accused of the criminal offense of counterfeiting money because on July 6, 2018, at an unspecified time in the "Waikiki" shopping center, he, together with Arbër Idrizi, Florent Nexhipi and Altin Dalipi, with the aim of material gain, knowingly put counterfeit money into circulation, in such a way that after making several purchases in this center, he made a payment in the amount of 500 euros, so that immediately after making the payment they left the scene, in which case their actions caused material damage in the amount of 500 euros./Kallxo.com/
