The Supreme Court provides additional details on the notification of pensioners

The Supreme Court has provided additional details regarding the procedures for reporting, suspension of payments, and return of funds in cases of pension misuse.

The Supreme Court emphasizes that it has fully fulfilled its part of the responsibility, while the responsibility for implementing this judgment falls on the executive institutions and not on the courts.

"The Supreme Court has no legal competence to monitor or supervise the implementation of judicial decisions by other institutions. Judicial decisions are mandatory for implementation and any failure to comply with them constitutes a violation of the principle of the rule of law. The judgment and the relevant notice have also been published on the official website of the Supreme Court," the Supreme Court's announcement states.

Supreme Court clarification regarding judgment PAnr.16/2025

– The Supreme Court of Kosovo informs the public that, regarding the judgment PAnr.16/2025, it has taken all necessary actions within its constitutional and legal powers.

With this judgment, the Supreme Court has declared illegal and repealed: Article 4 paragraph 2 of Administrative Instruction no. 05/2015 (MLSW), as well as Article 5 paragraphs 1, 2, 3 and 4 of this Instruction, which deal with the procedures for notification, suspension from payment and return of funds in cases of misuse of pensions.
