The first meeting of the KPC with the new composition is held

Despite some technical problems, the first meeting of the Kosovo Prosecutorial Council (KPK) with the new composition was held, which was chaired by the Acting Chief State Prosecutor, Agon Qalaj, reports Ekonomia Online.

According to the legal framework in force, the Council consists of seven members, while only five members were present at this meeting, but still sufficient to create a quorum.

Qalaj said that this meeting has a constitutive and functional character. While member Visar Krasniqi requested that the agenda also include the certification of the results of the election process of November 1, 2025, for the prosecutor member of the Council.

"In the absence of the elected Chairperson of the Council, the procedural direction of this meeting is carried out by the Acting Chief State Prosecutor, in the capacity of an ex officio member, in order to guarantee institutional continuity, respect for procedures and the regular functioning of the Council until the election of the governing bodies. This meeting has a constitutive and functional character, as it marks the formal beginning of the functioning of the Council in the new legal and institutional configuration, and aims to create procedural prerequisites for the sustainable and lawful functioning of the Council. The primary purpose of this meeting is not to address meritorious or contentious issues, but to build the organizational and procedural basis on which the Council will exercise its powers in the future", he stated.

He further said that by calling this meeting, he had initially requested a legal opinion from the KPK legal office.

“Given the institutional circumstances, legal and structural changes, as well as the issues raised by some members through official communications, prior to convening this meeting, I requested a legal opinion from the Legal Office of the KPC, in order to ensure technical guidance and unified procedural interpretation. This opinion has an advisory character and serves as a technical guide for respecting the principles of legality, legal certainty and procedural order. The opinion confirmed that the first meeting of the Council with the new composition should be treated as a meeting with a constitutive and functionalizing character, oriented towards creating the prerequisites for the regular institutional functioning. In this context, the agenda for this meeting has been determined in accordance with the legal framework in force and includes only issues directly related to the organization and initial functionalization of the Council, such as: Review and approval of the Regulation for the election of the Chairperson and Deputy Chairperson; Making a decision on announcing a public call for candidacies for the Chairperson and Deputy Chairperson of the KPC. This agenda has been constructed "to guarantee legality, institutional stability and legal certainty, as well as to avoid taking actions that may violate ongoing judicial procedures or the fundamental principles of public administration," he underlined.

While member Visari Krasniqi also requested that the agenda include an item to supplement/amend the Regulation on the election of the chairperson and deputy chairperson of the Kosovo Prosecutorial Council in accordance with the Law on Amending and Supplementing the Law on the Kosovo Prosecutorial Council, reports "Oath for Justice".

According to him, three members - Dardan Vuniqi, Arian Gashi and himself - have requested this agenda. However, Krasniqi claims that the acting Chief State Prosecutor, Agron Qalaj, is obstructing the functioning of the Council with his actions.

According to Krasniqi, Elza Bajrami-Kastrati was voted in with 74 votes and that these actions are acting against the will of the prosecutors and are hindering the exercise of the elected member's mandate.

"The KPK cannot delay certification when there is no procedural violation," said Krasniqi.

Qalaj said that the proposal is not related to the initial operation.

"The proposal was not related to the initial operation, therefore it cannot be placed as the first item on the agenda," he said.

Member Arian Gashi said he supports member Krasniqi's proposal.

"What I saw from the opening speech, you said you have a legal opinion, for the sake of, I am not equipped with such a legal opinion. Tomorrow there is such an opinion, it would be good to equip us. We cannot discuss until we are equipped with this opinion, I have two questions: where did this opinion come from," he said.

Qelaj said that he sought the opinion at his own request.

"On the issue of leading the meeting, I have personally requested, with authorization, to seek an opinion on a technical aspect. The opinion that I have obtained upon my request will be part of the file of this meeting. I will assist in the defense and leadership of this meeting," he said.

Another member, Dardan Foniqi, had a regret.

"I regret the protagonism of this meeting. I will add three words about the legal opinion: it must be supported by legal character and procedure, in other circumstances you may not express it. An opinion of such character cannot serve. I ask that we not equip the principles. I consider that our positions be respected," he said.
