Court remands three terrorism suspects
The Basic Court in Pristina has approved the request of the Special Prosecution of the Republic of Kosovo, for the imposition of a detention measure against the defendants RK, AA and LM, due to the well-founded suspicion that they have committed the criminal offenses Preparation of terrorist acts or criminal offenses against the Constitutional Order and Security of the Republic of Kosovo under Article 144, paragraph 3, in connection with the criminal offense of committing a terrorist act under Article 136, in connection with Article 31 of the Criminal Code, respectively for the defendants AA and LM and the criminal offense of Unauthorized Ownership, Control or Possession of Weapons under Article 374, paragraph 1 of the Criminal Code.
The defendants RK, AA and LM were ordered to be detained for a period of one (1) month, from 29.06.2018 to 29.07.2018. There is a well-founded suspicion that the defendants RK, AA and LM have committed the criminal offense of Preparation of terrorist acts or criminal offenses against the Constitutional Order and Security of the Republic of Kosovo under Article 144, paragraph 3, in connection with the criminal offenses of Committing a terrorist act under Article 136 and Assisting in the commission of terrorism under Article 137, paragraph 3 of the CCRK in connection with Article 31 of the CCRK.
The court has found that since there is evidence that the accused were preparing terrorist acts in Kosovo, the request for the imposition of a detention order against the three defendants is an adequate and necessary measure at this stage of the procedure, to ensure their presence in the criminal proceedings and the unimpeded development of the proceedings, since there are circumstances that indicate the risk that the same may repeat criminal offenses of the same or different type and nature, taking into account the gravity of the criminal offenses, their personal characteristics and the circumstances in which the same have acted continuously.
The parties have the right to appeal this decision to the Court of Appeal of Kosovo.Indeksonline/
