Switzerland expels the problematic Kosovar, he lived there for 20 years

Although, according to the "catalog" that determines deportation from the country, his crimes were not enough to force him to be deported, the Aargau Court had decided to deport the Kosovar, who is in his thirties, with a three-year ban on entering Switzerland.

After that, the Federal Court also rejected the complaint of the person in question from the Kulm district of the Canton of Aargau, writes the Aargauer Zeitung.

A psychiatric report states that "he shows a very high degree of indifference to the country's legal system."

The aforementioned person had come to Switzerland about 20 years ago, when he was eleven years old.

Although he had not completed any apprenticeship here (a trade), he had always worked in temporary jobs and had never received social assistance. The latest entries in his “complex” criminal record are from a series of criminal offenses starting on the night of May 11, 2019.

The perpetrator of the crimes was driving a car in Aarau when he encountered a police check. The breath alcohol test showed about 1,1 per thousand, and for this reason, his driver's license was taken from him instead. But that didn't stop him from driving from his residence in Aarau to work several times a week from May to July. This could be determined later as the company's car park was secured.

On July 17, he was caught again by a police check. This time he was in his mother's car, in Schlossrued, reports albinfo.ch. The police, in addition to discovering that he was driving without a license – found that he was also drunk again, with a blood alcohol content of just under 1 promil.

Only three days later the person was caught again, almost in the same place and again with more than 1 promil of alcohol in the blood.

Five days later, on July 25, 2019, the situation escalated: He ran into a police checkpoint with his car in Aarau on Bahnhofstrasse and did not follow the stop sign. In addition, he increased the speed of the car, as the police later described in a press release.

After some maneuvers on the road, his Audi hit a Mercedes from behind, spun and hit a wall, reports albinfo.ch. Like the two people in the Mercedes, the Audi driver suffered minor injuries.

This time, he was arrested on the spot. The amount of alcohol in your blood this time was measured at the hospital and it was 1.75 per thousand.

The District Court of Aarau sentenced him to 18 months in prison and a fine of 200 francs. She had revoked a decision by the Baden public prosecutor's office from 2017, which had sentenced her to a fine of 60 daily units of 130 francs for several road traffic violations. And, apart from that, she pronounced the decision to expel him from Switzerland for three years.

The accused already knows the reality of prison. He had a 2.5 year prison sentence in 2010 for, among other things, gang robbery. In that case, before the highest court, he had successfully managed to oppose the expulsion from the country, reports albinfo.ch.

The court found that the accused had "manifested considerable criminal energy in the case of his escape from a police patrol". It was "just a matter of luck" that there were no serious injuries or deaths in that accident.

The fact that the Kosovar has an illegitimate son, which his wife found out about only at the court hearing, is not enough to justify his stay in Switzerland. On the contrary: due to his separation from his wife - even if this separation is temporary - there can be no question of a stable family relationship in Switzerland, argues the court.

The Federal Court sees his problem the same way. It cannot speak of minor offenses in his case. "Despite the fact that he was on probation, which was continuing, he continued to commit even more serious offenses than before."

Thus, he must eventually leave the country for three years after serving his sentence.
